Increases the offense category to the next higher level for theft of petroleum products when the offender organized, supervised, financed, or managed others committing the offense

Enhances punishment for petroleum theft when the offender has a prior conviction for the same offense

Elevates the offense level when the petroleum theft involved conspiracy to commit criminal mischief (Section 28.03) or when the offender knowingly possessed a firearm during the commission of the offense

Caps the punishment enhancement so that first-degree felony offenses cannot be increased further under these provisions

Allows prosecution under this section, other applicable laws, or both when conduct constitutes multiple offenses; applies only to offenses committed on or after September 1, 2025
