Requires senior retirement communities (with 20+ units, providing common amenities like concierge, dining, housekeeping, or security) to prepare, maintain, and annually update a written emergency response plan

Emergency response plans must include disaster communication methods, on-site staffing during emergencies, provision of food/water/supplies, evacuation transport options, twice-yearly emergency planning meetings for residents, and information about utility critical care customer designations

Mandates that lease, rental, purchase agreements, or service contracts with residents include a copy of the emergency response plan and prohibits provisions that control residents' advance directives or testamentary documents

Prohibits senior retirement communities from preventing residents from communicating with law enforcement, social workers, or family about health and safety concerns, or from blocking officials and family from entering common areas for voluntary interviews during investigations

Exempts health care institutions, permitted boarding homes, HUD Section 202 supportive housing facilities, centers for independent living, and facilities regulated by HHSC or CMS from these requirements

Compliance deadline for emergency response plans is January 1, 2026; contract provisions apply to agreements entered into or renewed after September 1, 2025
