Amends Texas Penal Code Section 22.011 to consolidate and clarify circumstances under which sexual assault is considered without consent, including when the victim is unconscious, physically unable to resist, incapable of appraising the nature of the act, or unaware the assault is occurring

Adds a new provision establishing that sexual assault is without consent if the actor knows or reasonably should know the other person cannot consent due to intoxication or impairment by any substance

Creates explicit recognition that consent is withdrawn when the actor knows the other person has withdrawn consent and the actor persists in the act

Incorporates the statutory definition of "consent" from Section 1.07 of the Penal Code into the sexual assault statute

Applies only to offenses committed on or after September 1, 2025, with prior offenses governed by former law
