Requires any person, including electric cooperatives and municipally owned utilities, to obtain a permit from the Public Utility Commission of Texas before installing electric energy storage equipment or facilities intended for wholesale energy or ancillary services sales in the ERCOT power region

Mandates that permitted storage facilities be located a sufficient distance from other storage facilities to mitigate fire spread risk, and positioned so a fire would not block the only access point to residential areas

Permit applications must include the proposed location, equipment type, identification of the primary fire department or first responder, and confirmation that written notice was provided to that first responder entity

Commission must notify the county judge when applications are filed and may hold public meetings in the affected county; public meetings are required if requested by the local legislator or if substantial public interest exists

Applies only to electric energy storage equipment interconnected to transmission facilities on or after September 1, 2025, with the commission authorized to adopt fees to cover implementation costs
