Prohibits remaining trustees of an independent school district board from filling vacancies by appointment; vacancies must instead be filled at the district's next general election or through a special election

Extends the deadline for filling board vacancies from 180 days to 18 months after the vacancy occurs, and removes the previous requirement that more than one year remain in the term for mandatory filling

Allows property owners subject to the school district's ad valorem taxation to sue the board of trustees to enjoin violations of the vacancy-filling requirements

Permits prevailing plaintiffs in enforcement actions to recover damages, reasonable attorney's fees, and court costs without first completing an administrative grievance process

Waives governmental immunity from suit for school district boards to the extent of liability created under these vacancy provisions; effective September 1, 2025
