Creates a new criminal offense for operators of assisted living facilities who abandon residents or authorize employees to abandon residents during a declared state of disaster or local state of disaster

Defines "abandon" as leaving a resident without providing reasonable or necessary care in circumstances where no reasonable person would leave a resident of that age and ability

Establishes the base offense as a state jail felony

Increases penalty to a third degree felony if the resident suffers bodily injury, second degree felony for serious bodily injury, and first degree felony if the resident dies as a result of the abandonment

Takes effect September 1, 2025
