Health insurance issuers and HMOs must publicly disclose on their websites and provide written notice to insureds, enrollees, and contracting physicians whether they use AI-based algorithms in utilization review

AI algorithms and their training data sets used for utilization review must minimize bias based on race, color, religion, ancestry, age, sex, gender, national origin, or disability, and must comply with evidence-based clinical guidelines

Insurers and utilization review agents must submit annual AI compliance statements to the Texas Department of Insurance by December 31, including algorithm function summaries, decision logic trees, training data descriptions, and attestations of compliance

The Insurance Commissioner may require additional documentation or conduct inspections of AI algorithms and training data sets if there is reason to believe non-compliance

Information submitted to the department regarding AI algorithms is confidential and exempt from public disclosure; the act takes effect September 1, 2025
