Limits resident tuition eligibility for nonresident scholarship students to those who are U.S. citizens, lawful permanent residents, hold valid nonimmigrant visas, or are otherwise lawfully present in the United States

Maintains the existing 5% cap on nonresident scholarship students paying resident tuition at most public higher education institutions

Increases the cap to 20% for institutions located in local workforce development areas with population growth rates below the statewide average (per the most recent federal census) and that have sufficient capacity as determined by the Texas Higher Education Coordinating Board's space usage efficiency report

Directs the Texas Higher Education Coordinating Board to adopt rules to implement these provisions

Takes effect immediately with a two-thirds vote or September 1, 2025, and applies beginning with the 2025-2026 academic year
