Producers selling eggs from their own flock may sell unlimited ungraded eggs directly to consumers and up to 500 dozen ungraded eggs per week at wholesale in Texas

Ungraded egg cartons must display a legible label on the top panel containing the word "ungraded," producer's name, address, pack date, and registration number (for wholesale sales)

Producers selling ungraded eggs at wholesale must register with the Texas Department of Agriculture and may be charged an annual registration fee of up to $50

Wholesale sellers must refrigerate eggs within 36 hours of collection, maintain storage and distribution temperatures at 45°F or below, follow sanitation requirements, and keep required records

State agencies and political subdivisions are prohibited from barring certain persons from purchasing, reselling, or using properly labeled ungraded eggs
