Creates a new criminal offense under Texas Penal Code Section 46.04 for possessing a firearm while not lawfully present in the United States

Classifies the offense as a third-degree felony, which in Texas carries a potential penalty of 2-10 years in prison and up to a $10,000 fine

Amends existing law that already prohibits firearm possession by convicted felons and certain other categories of persons

Takes effect immediately if passed by two-thirds vote of both chambers; otherwise takes effect September 1, 2025
