Prohibits placing consumer energy storage modules (batteries and electrochemical devices that power consumer products) in mixed municipal solid waste facilities, mixed metal recycling facilities, or municipal recyclable material collection receptacles and curbside bins

Exempts lead-acid batteries, alkaline batteries, and batteries the Texas Commission on Environmental Quality (TCEQ) determines are safe for disposal from the new regulations

Protects individual consumers from civil, administrative, or criminal liability for inadvertent or incidental violations related to noncommercial household use of these batteries

Shields owners and operators of solid waste and recycling facilities from liability when consumer energy storage modules are improperly placed in their facilities, and removes any duty to locate or remove such modules

Requires TCEQ to adopt rules identifying businesses or facilities where consumers can properly recycle or dispose of consumer energy storage modules, and to determine which battery types are safe for regular disposal

Takes effect September 1, 2025
