Prohibits depositing food waste at composting facilities located in counties that do not have a municipality with a commercial food waste composting ordinance, if that waste was collected from a municipality that does have such an ordinance

Imposes a civil penalty of $1,000 per violation, enforceable by the attorney general through court action

Exempts agricultural operations, composting facilities where the county commissioners court authorizes such deposits by resolution or order, and facilities that were operating and accepting such food waste before January 1, 2025

Defines "commercial food waste composting ordinance" as a municipal ordinance requiring multifamily properties, food permit holders, or other businesses to divert food waste from landfills

Takes effect September 1, 2025
