Expands the definition of "qualifying cogenerator" in Texas Utilities Code to include owners or operators of dispatchable generation that provide thermal, steam, or waste heat to a colocated desalination facility while serving a load primarily used for manufacturing digital products

Exempts these qualifying cogenerators from being classified as retail electric providers or power generation companies when providing electricity to purchasers of their thermal output

Specifies that owners or operators of these qualifying cogenerators are not considered retail electric utilities when providing electricity to digital product manufacturers and thermal energy to colocated desalination facilities

Takes effect immediately upon receiving a two-thirds vote from both legislative chambers, or September 1, 2025, if that threshold is not met
