Expands confidentiality protections for information submitted to the Public Utility Commission regarding Texas Energy Fund loans and grants, making all information submitted "at any time" for award determinations exempt from public disclosure rather than just application materials

Allows municipally owned utilities and electric cooperatives to structure construction loans as public securities payable on parity with other senior-lien debt, providing more financing flexibility

Separates the 10,000 megawatt generation capacity cap so that loans and grants each have their own independent 10,000 megawatt limit, rather than sharing a combined cap

Permits the commission to disburse initial loan funds after December 31, 2025, on a case-by-case basis if market factors necessitate extending the deadline, removing the previous hard cutoff date

Applies retroactively to loan applications pending before the commission on the effective date; takes effect immediately with two-thirds legislative vote or September 1, 2025
