Water supply or sewer service corporations operating in the ERCOT region may register as power generation companies under Section 39.351 of the Utilities Code

Registered corporations may generate and sell electric power in the ERCOT power region to produce revenue

Revenue from electricity sales is restricted to covering costs of power production (administration, employees, equipment, fuel, maintenance) or purposes described in Section 67.002 of the Water Code

Corporations selling electric power must account for and use that revenue in compliance with Section 67.004 of the Water Code

Effective date is September 1, 2025
