Prohibits businesses in Texas from selling, offering for sale, or holding for sale "obscene devices" unless the business is a sexually oriented business operating in compliance with state law

Defines "obscene device" by reference to Section 43.21 of the Penal Code and "sexually oriented business" by reference to Section 243.002 of the Local Government Code

Authorizes county or district attorneys to seek injunctions in district court against businesses violating the sales restriction

Allows courts to impose civil penalties up to $5,000 per violation and order reimbursement of investigation and prosecution costs to the county or district

Takes effect immediately if passed by two-thirds vote of both legislative chambers, otherwise takes effect September 1, 2025
