Exempts wells withdrawing groundwater from designated brackish groundwater production zones from district permit requirements if the water has at least 3,000 milligrams per liter total dissolved solids and the operator has acquired necessary property rights for the spacing area

Removes the prohibition on designating brackish groundwater production zones in areas used for wastewater injection wells, instead requiring zone descriptions to identify such areas

Requires the Texas Water Development Board to allocate available brackish groundwater amounts to each groundwater conservation district and county located within designated production zones

Limits transport or export fees for exempt brackish groundwater wells to no more than 10 cents per thousand gallons and prohibits production fees for water produced under the exemption

Allows groundwater conservation districts to cancel exemptions if operators fail to maintain required monitoring systems or if evidence shows production is negatively impacting water quality in adjacent aquifers or causing subsidence
