Expands mandatory health benefit plan coverage for biomarker testing to explicitly include organ transplant recipients for diagnosis, treatment, management, and ongoing monitoring purposes

Requires biomarker tests to be supported by medical and scientific evidence including FDA-approved or cleared tests, CMS coverage determinations, nationally recognized clinical practice guidelines, or consensus statements

Applies to health benefit plans delivered, issued, or renewed on or after January 1, 2026

Allows state agencies to delay implementation if federal waivers or authorizations are needed

Takes effect September 1, 2025
