Repeals Section 21.06 of the Texas Penal Code, which criminalizes homosexual conduct (this statute has been unenforceable since the 2003 U.S. Supreme Court ruling in Lawrence v. Texas)

Amends Health and Safety Code Section 85.007(b) to remove language stating that homosexual conduct is a criminal offense, while retaining language that education programs for minors must state homosexual conduct is "not an acceptable lifestyle"

Amends Health and Safety Code Section 163.002 regarding sexual education instructional elements to remove the reference to homosexual conduct being a criminal offense, while maintaining language that homosexuality is "not a lifestyle acceptable to the general public"

Takes effect immediately upon receiving a two-thirds vote from both chambers, or September 1, 2025, if the two-thirds threshold is not met
