Creates Travis County Municipal Utility District No. 40 as a municipal utility district under Section 59, Article XVI, Texas Constitution, encompassing approximately 56.62 acres across three tracts in the Augustus Kincheloe Survey in Travis County

Establishes a five-member board of directors with temporary directors appointed by the Texas Commission on Environmental Quality upon petition by owners of a majority of assessed property value; permanent directors to be elected following a confirmation election

Grants the district authority to design, construct, finance, and maintain roads (macadamized, graveled, or paved) and storm drainage improvements, with road project bonds limited to one-fourth of the district's assessed real property value

Authorizes the district to issue bonds, impose ad valorem taxes (with voter approval), levy operation and maintenance taxes, and collect assessments and fees to fund district purposes

Grants limited eminent domain power if the Act receives a two-thirds vote in both legislative chambers; if not, the district explicitly cannot exercise eminent domain authority
