Prohibits construction of concrete batch plants within 880 yards of residences under permit amendments, and prohibits concrete crushing facilities and concrete plants (wet batching, dry batching, or central mixing) within 2,000 yards of hospitals

Requires the Texas Commission on Environmental Quality to prohibit operation of concrete crushing facilities within 440 yards of residences, schools, or places of worship

Establishes a 2,000-yard buffer zone prohibiting operation of concrete crushing facilities and concrete batching plants near hospitals

Exempts facilities authorized before September 1, 2001, facilities that met distance requirements at initial application, and certain enclosed crushing facilities near international borders in municipalities with populations between 6,100 and 20,000

Applies to permit applications filed on or after the effective date and to permits subject to pending litigation, with immediate effect upon passage
