Prohibits public institutions of higher education from taking action against student organizations based on requirements that leaders or members affirm the organization's sincerely held beliefs, comply with standards of conduct, or further the organization's mission

Allows persons or student organizations to sue institutions within one year of an alleged violation, seeking declaratory judgment or injunctive relief to prevent further violations

Establishes that each day a violating policy remains in effect constitutes a separate violation for purposes of the one-year limitation period

Permits individuals or organizations to raise violations of these protections as a defense or counterclaim in any civil, administrative, or disciplinary proceedings brought by the institution

Waives sovereign immunity for public institutions of higher education to the extent of liability created under these provisions, with an effective date of September 1, 2025
