Adds a new provision to Texas sexual assault law establishing that consent is absent when the actor knows the other person is intoxicated by any substance to the point of being incapable of appraising the nature of the act

Creates an explicit legal standard that sexual assault occurs when the actor knows the other person has withdrawn consent and persists in the act after consent is withdrawn

Amends Section 22.011(b) of the Texas Penal Code by adding two new categories (subdivisions 15 and 16) to the existing list of circumstances that constitute lack of consent

Applies only to offenses committed on or after September 1, 2025; offenses before that date remain governed by prior law
