Requires the Texas Commission on Environmental Quality (TCEQ) to conduct additional analysis before issuing air quality permits for major stationary sources in federally-designated nonattainment areas under the Clean Air Act

Mandates analysis of alternative locations, facility sizes, production processes, and environmental control techniques to demonstrate that facility benefits significantly outweigh environmental and social costs

Requires consideration of cumulative impacts that would result from issuing the permit without changes to the proposed site location, size, production processes, or environmental controls

Applies to permit applications pending before TCEQ on or after September 1, 2025

Uses federal definitions from 40 C.F.R. Section 51.165 (as of January 1, 2025) for "major stationary source" and "major modification"
