Expands Texas's distracted driving law from prohibiting only electronic messaging while driving to prohibiting all use of portable wireless communication devices unless the vehicle is stopped outside a lane of travel

Allows hands-free device use as an affirmative defense for adult drivers, but this defense is not available to drivers under 18 years of age or school bus operators with minor passengers aboard

Defines "hands-free device" as speakerphone capability, attachments, or equipment allowing phone use without hands except for a single swipe or tap to activate functions, including voice-operated technology and push-to-talk features

Exempts emergency/law enforcement vehicle operators acting in official capacity and commercial motor vehicle operators (except school buses with minors) when use complies with federal motor carrier safety regulations

Preempts all local ordinances regulating wireless device use while driving and requires TxDOT to post signs at state entry points on interstate and U.S. highways informing drivers of the prohibition and fine
