Health benefit plans that cover general anesthesia cannot exclude coverage for medically necessary general anesthesia during dental services for children under 13 years of age who have a documented physical, mental, or medical reason preventing them from undergoing dental procedures without anesthesia

The anesthesia must be performed by a qualified provider of anesthesia services to qualify for coverage

Applies to a broad range of health plans including insurance companies, HMOs, group hospital service corporations, small employer plans, state employee plans (ERS, TRS), and self-funded plans sponsored by professional employer organizations

Does not require health benefit plans to provide coverage for the underlying dental care or procedures themselves—only the anesthesia services when medically necessary

Takes effect September 1, 2025, and applies to health benefit plans delivered, issued, or renewed on or after January 1, 2026
