Cemetery organizations may adopt rules specifying the style, color, size, and installation requirements of markers, memorials, and effigies, including whether they must be installed flat or erect

Cemetery organizations are prohibited from adopting or enforcing rules that restrict which businesses plot owners may use to purchase markers, memorials, or effigies, or to contract for their installation

Violations of the prohibition on restricting business choices carry a civil penalty of up to $5,000 per violation, with each day of a continuing violation counted as a separate offense

The Texas Attorney General is authorized to bring suit to recover civil penalties for violations

The act takes effect September 1, 2025, and applies only to violations occurring on or after that date
