Raises the minimum age to purchase nitrous oxide from 18 to 21 years old, while maintaining the 18-year age requirement for delivery of nitrous oxide and other abusable volatile chemicals

Makes it a state jail felony to knowingly sell nitrous oxide to a person under 21 or deliver nitrous oxide to a person under 18

Requires retail businesses selling abusable volatile chemicals to display bilingual signs (English and Spanish) warning that selling nitrous oxide to persons under 21 is unlawful

Creates an affirmative defense for sellers if the buyer presented a valid Texas driver's license or DPS identification showing they were 21 or older, or if the nitrous oxide was for a lawful commercial purpose

Takes effect September 1, 2025, and applies only to offenses committed on or after that date
