Hospitals with emergency departments or that regularly provide emergency services must submit written summaries of their emergency operations plans to the Health and Human Services Commission, specifically addressing patient diversion procedures during cyber attacks or electrical power outages

Emergency operations plans cover processes for temporarily routing patients to other hospitals when a facility's capacity is significantly diminished and delayed care would result in worse health outcomes

Hospitals must submit updated summaries within 30 days of any changes to their diversion plans being adopted by the governing body or approved by hospital administrators

All summaries submitted to the commission are confidential and exempt from public disclosure under the Texas Public Information Act

Hospitals must comply with these requirements by December 1, 2025, with the act taking effect September 1, 2025
