State registrars, local registrars, and county clerks must issue certified birth record copies to homeless individuals without charging a fee

"Homeless individual" is defined as someone lacking a fixed, regular, adequate nighttime residence, or whose primary residence is a temporary shelter, transitional housing, institution, or place not designed for sleeping accommodations

Individuals imprisoned or detained in correctional facilities are explicitly excluded from the definition of homeless individual

The executive commissioner of the Health and Human Services Commission must adopt rules establishing a verification process for homeless status and prescribe required documentation

Homeless individuals cannot be required to provide a physical residential address to obtain their birth record; the Act takes effect September 1, 2025
