TX SB809

Expands the offense for criminal street gang members carrying firearms from only handguns in motor vehicles or watercraft to carrying any firearm on or about their person

Requires that the gang member also be engaged in conduct constituting a Class B misdemeanor or higher offense for the firearm possession to be criminal under this section

Specifies qualifying offenses include those listed in probation restriction statutes, organized crime statutes, offenses under Penal Code Titles 5, 6, or 7 (crimes against persons, family, and property), controlled substance offenses, or any offense where the firearm was used or exhibited

Increases the penalty for this offense from a Class A misdemeanor to a third degree felony

Applies only to offenses committed on or after September 1, 2025
