TX SB90

Prohibits state officials, employees, or agents from restricting or prohibiting physicians from prescribing, administering, or dispensing FDA-approved prescription drugs for off-label uses (uses other than the approved indication)

Protects physicians from adverse licensing actions by the Texas Medical Board based solely on off-label prescribing, provided the treatment meets the medical standard of care

Explicitly excludes abortion-inducing drugs from the protections granted under this chapter

Provides that the law does not create any private or state cause of action against drug manufacturers, physicians, or other care providers for patient harm resulting from off-label drug use

Takes effect immediately with two-thirds legislative vote, otherwise September 1, 2025
