Allows a person to petition a court for a pre-suit deposition to perpetuate testimony for an anticipated action or to investigate a potential claim

Prohibits requesting a pre-suit deposition if the person has not sustained or does not reasonably expect to sustain actual damages in the anticipated claim or action

Makes a person who files a petition in violation of this requirement liable for attorney's fees incurred by each person named in the deposition petition who defended against it

Prevents the Texas Supreme Court from modifying or repealing this section through court rules

Takes effect immediately upon receiving a two-thirds vote in both chambers, otherwise September 1, 2025
