Health care practitioners present when a child is born alive after an abortion must provide the same degree of care as would be given to any other child born at the same gestational age, then immediately transport and admit the child to a hospital

Violations carry criminal penalties of fines and up to 5 years imprisonment; intentionally killing a child born alive is punishable as murder under 18 U.S.C. § 1111

Health care practitioners and facility employees must immediately report any violations to state or federal law enforcement

The woman on whom the abortion was performed may bring civil suit for damages including actual damages, statutory damages equal to 3 times the cost of the abortion, punitive damages, and attorney's fees

The mother cannot be prosecuted under this law; constitutional authority is claimed under the 14th Amendment equal protection clause and the Commerce Clause
