Secretary of Homeland Security may suspend entry of aliens at international land or maritime borders when deemed necessary to achieve operational control over the border

Secretary is required to prohibit entry of covered aliens during any period when DHS cannot detain them as required under existing immigration law or place them in appropriate monitoring programs

"Covered aliens" are defined as those seeking entry who are inadmissible due to lack of valid entry documents under section 212(a)(7) of the Immigration and Nationality Act

State attorneys general may sue the Secretary of Homeland Security in federal district court to obtain injunctive relief if the mandatory suspension requirements are not being followed
