Amends the Migratory Bird Treaty Act to explicitly prohibit incidental take (unintentional killing) of migratory birds without authorization from the U.S. Fish and Wildlife Service

Establishes civil penalties up to $10,000 per violation for unpermitted incidental take, with reckless or grossly negligent conduct subject to criminal penalties under existing law

Directs the Secretary of the Interior to issue regulations and general permits authorizing incidental take, with Director's Order No. 225 (October 2021) remaining in effect until industry-specific regulations are promulgated

Creates the "Migratory Bird Recovery Fund" in the Treasury to receive permit fees, civil penalties, appropriations, and donations for bird conservation, with $10,000,000 authorized annually

Requires a research program to monitor bird populations and identify mitigation measures, plus reports to Congress every 5 years on migratory bird conservation status and program progress
