Small business contractors with federal construction contracts may request an equitable adjustment when a contracting officer directs changes to contract terms without the contractor's agreement

Federal agencies must provide interim partial payments of at least 50% of the estimated additional costs when a small business submits a timely equitable adjustment request

Interim partial payments cannot be considered an action to definitize or finalize the equitable adjustment request

Prime contractors receiving interim payments must flow down the appropriate portion to first-tier subcontractors, who must then pay subcontractors at any tier for their share of increased costs

SBA Administrator must implement the requirements by the earlier of the first full fiscal year after enactment or October 1, 2027
