Defense contractors must report to contracting officers within 30 days when prices on non-competitive contracts exceed 25% above the bid price, 25% above what the government paid the previous year, or 50% above prices from more than five years prior

Applies specifically to contracts awarded using non-competitive procedures under section 3204 of title 10 or section 6.302 of the Federal Acquisition Regulation

Contractors who fail to submit required reports will be flagged in the Federal Awardee Performance and Integrity Information System (FAPIIS)

Noncompliance entries must include the contractor's identity, product/service details, national stock number, order quantity, unit and total cost, purchasing entity, and order date
