Public institutions of higher education receiving federal assistance must charge in-state tuition rates to residents of Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, and the United States Virgin Islands

Covered individuals must be both a resident of one of these four U.S. territories and a national of the United States as defined under the Immigration and Nationality Act

Amends the Higher Education Act of 1965 by adding a new Section 135A establishing these tuition requirements

Requires institutions to include compliance with these in-state tuition provisions as part of their program participation agreements under Section 487(a)
