H.R. 7640 - Shut Down Sanctuary Policies Act of 2026

• Prohibits state and local governments from restricting their officials' ability to cooperate with federal immigration enforcement, including sharing citizenship/immigration status information and complying with DHS detainers

• Requires DHS to issue immigration detainers for individuals arrested by any law enforcement entity when there is probable cause to believe they are inadmissible or deportable, with custody transfer within 48-96 hours

• Strips federal funding eligibility from non-compliant jurisdictions, including COPS grants, Byrne Justice Assistance Grants, and other DHS/DOJ law enforcement grants for at least one year

• Provides immunity to state/local governments and officials who comply with federal immigration enforcement activities, allowing removal of related lawsuits to federal court with the U.S. Government substituted as defendant

• Creates a private right of action allowing crime victims (or their families) to sue sanctuary jurisdictions for compensatory damages when an alien commits murder, rape, or felonies after being released due to the jurisdiction declining a detainer, with a 10-year statute of limitations
