Secretary of Homeland Security prohibited from obligating funds for ICE biometric/surveillance systems (including the Intelligence Records System), related contracts, or hiring additional ICE personnel until a required report is submitted to Congress

Required report must establish ICE policy prohibiting use of surveillance systems to access or store information collected while individuals exercise constitutional rights, and must include rules on data use, access, storage, retention, and individual notice procedures

Policy must define what constitutes "credible threat activity" to ensure First Amendment-protected activities are excluded, and must detail database costs, contracts, and officer training on local privacy laws

All information collected by ICE for biometric/surveillance systems between January 1, 2026, and date of enactment must be deleted within 30 days unless the Secretary establishes the required policy by rule

Prohibits use of DHS funds to restrict individuals from recording or documenting immigration enforcement operations, provided such recording does not interfere with operations
