Members of the Chinese Communist Party (CCP), including those who have served on the National Congress, are barred from receiving F visas (student) or J visas (exchange visitor)

Family members of CCP members—including spouses, children, parents, siblings, grandchildren, nieces, and nephews—are also ineligible for these visas

An exception exists for admissions necessary to comply with the 1947 United Nations Headquarters Agreement and other international obligations

The President or a designee may waive the restrictions by certifying in writing to Congress that doing so is in the national security interest of the United States
