Creates new criminal penalties for visa overstays of 10 days or more, including fines and up to 6 months imprisonment for first offense, or up to 2 years for subsequent offenses or those with prior illegal entry convictions

Establishes civil penalties of $500-$1,000 per visa overstay violation, doubled to $1,000-$2,000 for repeat offenders

Increases existing civil penalties for illegal entry from $50-$250 to $500-$1,000

Applies enhanced illegal entry penalties to those previously convicted of visa overstay offenses, treating them as subsequent offenders

Amends Section 275 of the Immigration and Nationality Act (8 U.S.C. 1325) to expand enforcement against nonimmigrants who fail to maintain authorized status or comply with visa conditions
