Commissioner of Social Security must share state death data with the Do Not Pay working system to prevent improper payments to deceased individuals and support recovery of improperly paid benefits

Social Security Administration and the Do Not Pay system operator must enter into a cost-sharing agreement for the proportional share of state death data costs, subject to periodic review

Death records may only be added to the system when the Commissioner has "clear and convincing evidence" that an individual should be presumed deceased

When someone is incorrectly identified as deceased, agencies with cooperative data-sharing arrangements must be notified of the error

Amendments take effect on December 27, 2026
