Summary of S. 3482 - First Step Implementation Act of 2025

• Retroactive application of First Step Act sentencing reforms allows courts to reduce sentences for drug offenses committed before December 21, 2018, applying the reduced mandatory minimums from the 2018 First Step Act to previously sentenced defendants upon motion by the defendant, Bureau of Prisons, government, or court

• Modifies the "safety valve" provision for federal drug offenses, permitting judges to waive criminal history requirements when imposing sentences below mandatory minimums if the defendant's record substantially overrepresents their criminal history or likelihood of reoffending (excludes those convicted of serious drug felonies or serious violent felonies)

• Creates parole eligibility for juvenile offenders who committed crimes before age 18 and were sentenced as adults, allowing sentence modification after serving 20 years if the court finds they are not dangerous and justice warrants release, with mandatory minimum 5 years supervised release

• Establishes automatic sealing and expungement of federal juvenile records for nonviolent offenses, with automatic sealing 3 years after completing supervision, automatic expungement for offenses committed before age 15, and petition-based expungement for offenses committed at ages 15-17

• Requires improved accuracy of federal criminal records by mandating the Attorney General establish procedures to correct incomplete or inaccurate records, prohibiting exchange of arrest records older than 2 years without disposition information, and providing applicants opportunity to challenge record accuracy before employment-related disclosures
