Creates a civil cause of action against the U.S. government when CBP or ICE officers violate constitutional rights, including due process, protection from unreasonable searches, privacy, and free speech

Waives sovereign immunity for the federal government specifically for claims against CBP and ICE, allowing individuals to sue regardless of whether the violation resulted from official policy or custom

Permits plaintiffs to seek punitive damages and exempts these cases from the administrative claim requirement under 28 U.S.C. § 2675(a)

Directs monetary damages to be paid from appropriations under Title IX and sections 100051 and 100052 of Public Law 119-21, with backup funding from the permanent judgment fund

Preserves existing legal remedies against individual officers, agents, or other persons involved in the violation
