S. 3773 - Enforce Immigration or Lose Transportation Act

• Withholds 5% of federal highway funding from non-compliant states in the first year, increasing to 10% in subsequent years, beginning October 1, 2026

• States lose compliance status by issuing driver's licenses without proof of lawful immigration status, restricting information sharing with DHS about individuals' citizenship/immigration status, or refusing to honor ICE detainers

• Requires states to annually certify compliance to the Secretary of Transportation, including submission of relevant statutes, policies, and driver's license issuance data

• Authorizes the Secretary to conduct audits of state certifications, issue implementing regulations with appeal procedures, and provide technical assistance to help states achieve compliance

• Withheld funds may be restored during the same fiscal year if a state comes into compliance before year-end
