Assisted living facilities must submit a transition plan to the Division of Licensing at least 120 days before closure, qualifying sale, or change of use, and provide written notification to residents, responsible persons, the ombudsman, and the division at least 45 days in advance

Facilities intending to close, complete a qualifying sale, or change use are prohibited from accepting new residents once they submit their transition plan

Transition plans must include relocation options within a 60-mile radius, address residents with specialized care needs, and facilities cannot close until all affected residents have been relocated to appropriate alternative settings

For acquisition sales where the facility continues operating, purchasers must notify residents within 5 days and cannot raise rates for existing residents until at least 60 days after the sale with 30-day advance notice required

County attorneys or the attorney general may petition a court to appoint a receiver to take charge of facilities that fail to comply with these requirements; effective date is May 6, 2026
