Summary of H.B. 108: Minors in State Custody Amendments

• Reduces the percentage of a minor beneficiary's federal benefits that the Department of Health and Human Services may use for maintenance costs from 75% to 25%.

• Requires the department to conserve or invest the remaining 75% of federal benefits not expended for maintenance costs.

• Federal benefits covered include those from Social Security Administration, Department of Veterans Affairs, and Railroad Retirement Board.

• Takes effect on May 6, 2026.
