Home-based scholarship students are prohibited from enrolling in a public school (LEA) to repeat a grade level for which they already received scholarship funds, unless diagnosed with a significant learning disability/developmental delay or documented extenuating circumstances prevented completion of grade-level work

The Department of Operations must establish a reporting process for LEAs to flag instances where former home-based scholarship students seek to enroll and repeat a previously-funded grade level

Program managers must verify grade-level progression compliance before allowing former home-based scholarship students to enroll in public schools

The bill takes effect May 6, 2026
